These Terms and Conditions (the “Terms”) are an agreement between you and Onyx Marketing LLC, a New York limited liability company doing business under the brand name The Bowl Method (“The Bowl Method,” “we,” “us,” or “our”). Our mailing address is 312 W 2nd St #3219, Casper, WY 82601, USA.
By accessing our website, purchasing a product, or joining The Bowl Club, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the website or purchase our products or services.
1. Eligibility and international customers
You must be at least 18 years old and legally able to enter into a binding contract to use our paid products or services. By purchasing, you represent that you meet these requirements.
We sell internationally. You are responsible for ensuring that your purchase and use of our materials are lawful where you live. Nothing in these Terms limits any non-waivable consumer right or remedy that applies to you under the laws of your country, state, province, or territory.
2. Educational information—not veterinary care
The Bowl Method provides educational information for dog owners. It is not veterinary advice, a diagnosis, a prescription, or a treatment plan for any individual animal.
Our materials do not diagnose, treat, cure, or prevent disease and are not a substitute for care from a veterinarian who has examined your dog. Always speak with your own veterinarian before changing what your dog eats. Never change or replace a therapeutic or prescription diet without first speaking with the veterinarian who prescribed it.
Recipes, feeding charts, calculations, examples, ingredient information, and other materials must be used with judgment and in light of your dog’s age, health, medications, allergies, laboratory results, and individual needs. Results vary, and no particular health result is promised.
If you believe your dog has eaten something harmful or is experiencing an emergency, contact your veterinarian or an animal poison-control service immediately. Do not wait for a response from us.
3. Products, pricing, and digital delivery
We sell downloadable educational materials, printables, digital guides, access to a member library, and an optional recurring membership. Product descriptions, included materials, price, currency, billing frequency, and any taxes shown at checkout form part of your purchase.
One-time purchases do not renew. The Bowl Club is separate and renews as described below. Unless expressly stated otherwise, nothing will be physically shipped.
Digital products are normally delivered on the confirmation screen, by email, through the member library, or by a combination of those methods. You are responsible for providing a complete and accurate email address and for checking spam or promotions folders. Contact [email protected] if delivery does not arrive.
We may correct genuine pricing, typographical, or technical errors before fulfilling an order. If we cannot fulfill an order at the price charged, we will notify you and issue a refund.
4. The Bowl Club subscription
The Bowl Club is an automatically renewing monthly membership. Under the current offer, $1 covers the first 30 days. After that, the membership renews at $19 per month until cancelled. The amount, renewal frequency, and start date are displayed again before you submit payment. Any future offer with different terms will be governed by the terms clearly displayed and accepted at that checkout.
By joining, you expressly authorize us and our payment processor to charge the payment method you select for the initial amount and each recurring payment until cancellation. There is no minimum term and no cancellation fee.
Cancellation
Cancel at any time by emailing [email protected] or by replying to an email from us. Include the email address used for the membership so we can locate it. We process cancellations within one business day. Access to Bowl Club membership content ends when the cancellation is processed. Cancellation stops future charges but does not erase charges already processed; eligible refunds are described in our Refund Policy.
Where applicable law requires another cancellation method, reminder, acknowledgment, or timing rule, we will provide and honor it.
5. Payment and billing
Payments may be processed by Stripe, PayPal, or another payment provider identified at checkout. Your use of a payment service may also be subject to that provider’s terms and privacy practices. We do not receive or store your complete card number when payment is handled by a third-party processor.
You authorize the payment provider to charge the total displayed at checkout. You are responsible for accurate billing information and any taxes, duties, conversion fees, or bank fees that apply to your purchase. Prices may be displayed in U.S. dollars even when your payment provider converts the charge into another currency.
6. Refunds
Every one-time product is covered by our 60-calendar-day money-back guarantee. The Bowl Club’s initial $1 payment is refundable, and a member may request a refund of a monthly renewal that caught them by surprise. Full details and instructions are in our Refund Policy, which is incorporated into these Terms.
7. Personal-use license and intellectual property
The website and all products, recipes, text, charts, worksheets, designs, photographs, illustrations, videos, emails, and other materials we provide are owned by or licensed to Onyx Marketing LLC and are protected by intellectual-property laws.
When you purchase a product, we give you a limited, revocable, non-exclusive, non-transferable license to download, view, and print it for your own personal, non-commercial household use. A purchase is not a sale of our intellectual property.
You may not reproduce, upload, publish, sell, sublicense, share publicly, distribute to others, remove ownership notices from, use to train an artificial-intelligence system, or create a competing or derivative commercial product from our materials without our prior written permission. You may share an individual page with your own veterinarian when reasonably necessary for your dog’s care.
8. Questions, mailbag submissions, photographs, and testimonials
You may choose to send us questions, stories, photographs, feedback, testimonials, or other content, including content for possible use in The Bowl Club mailbag (“Submissions”). Do not send information you do not have the right to share. If another person appears in or contributed to a Submission, you must have their permission to submit it.
When you clearly submit content for possible publication or marketing use, you give Onyx Marketing LLC a worldwide, non-exclusive, royalty-free license to review, reproduce, edit for length or clarity, publish, display, and distribute that Submission in connection with The Bowl Method and its promotion. You retain ownership of your original content. We are not required to publish a Submission and may remove one from future use at our discretion.
We may remove names and identifying details when using a Submission, but you should not assume a Submission is confidential when you send it for possible publication. If you send a private support message that is not submitted for publication, we will not treat it as a public Submission merely because it contains feedback. Our handling of personal information is described in the Privacy Policy.
9. Acceptable use
You may not misuse the website, interfere with its security or operation, attempt unauthorized access, introduce malicious code, scrape or harvest information at scale, impersonate another person, use another customer’s account, or use our services for unlawful, fraudulent, or abusive purposes.
You are responsible for maintaining the confidentiality of any member-library access link or account credentials associated with your purchase and for activity occurring through your account.
10. Third-party services and links
Our website and fulfillment process rely on third-party services and may link to third-party websites. We do not control and are not responsible for third-party content, availability, security, or practices. A link does not necessarily mean we endorse every statement or product on the linked site.
11. Disclaimers
To the fullest extent permitted by law, the website, products, membership, and materials are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the website or member library will always be uninterrupted or error-free, that every message will be delivered by an email provider, or that any product will produce a specific result for you or your dog. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Onyx Marketing LLC and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss arising from reliance on educational materials in place of individualized veterinary care.
To the fullest extent permitted by law, our total liability arising from a product, membership, or these Terms will not exceed the amount you paid us for the product or service giving rise to the claim during the 12 months before the event giving rise to liability.
These limits do not exclude liability that cannot legally be excluded or limited, including any mandatory consumer remedy, or liability for fraud, willful misconduct, gross negligence, or personal injury where applicable law prohibits that exclusion.
13. Governing law and disputes
Before starting a formal dispute, please contact us at [email protected] so we can try to resolve it directly.
Except where the mandatory law of your place of residence requires otherwise, these Terms and any dispute arising from them are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any non-waivable right you have to bring a claim elsewhere, the state and federal courts located in New York will have jurisdiction.
14. Changes, suspension, and termination
We may update the website, products, or these Terms from time to time. The “last updated” date shows when these Terms last changed. Material changes will apply prospectively and will be communicated as required by law. Changes to an existing recurring membership will not take effect without any notice or consent required by applicable law.
We may suspend or end access when reasonably necessary to protect the website or other customers, respond to unlawful or abusive conduct, address nonpayment, or comply with law. Ending access does not eliminate rights or obligations that arose earlier, and provisions that by their nature should survive will survive.
15. General terms
If a court finds part of these Terms unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law. Our failure to enforce a provision once is not a waiver. You may not assign your agreement with us without our written consent; we may assign it as part of a merger, reorganization, sale of assets, or other lawful business transfer. These Terms, together with the policies and checkout disclosures referenced here, are the entire agreement concerning their subject matter.
